This Privacy Policy describes how Wolphy Apps ("we", "us", "our") collects, uses, discloses, and protects personal information when you use the Couple Cut mobile application ("App") on iOS. This Policy applies globally and is intended to meet the requirements of major privacy laws (e.g., GDPR, CCPA, COPPA, PIPEDA). By using the App you consent to the practices described below.

## 2. Important Notice: Third-Party AI Data Processing

Before you use the App's photo and video generation features, we want you to clearly understand the following:

- What data is sent: When you create AI-generated photos or videos, the photos you upload (which may include photos of you and your partner) are transmitted to third-party AI services for processing.

- Who receives your data: Your photos are sent to Wiro AI (our primary AI generation provider), which may route processing through third-party AI models including Google AI services and Midjourney.

- Why your data is sent: Your photos are processed solely to generate the AI-powered images and videos you request. They are not used for advertising, profiling, or any other purpose.

- How we obtain your consent: The App requests your explicit consent before any photos are sent to third-party AI services. During the onboarding process, you are presented with a clear explanation of this data sharing and must actively agree before proceeding. You may also review this information at any time in the App's settings.

- Your control: If you do not consent to this processing, you may choose not to use the AI generation features. You may delete any uploaded photos at any time from within the App.

This is summarized here for transparency. Full details are provided in Sections 4, 4A, and 5 below.

## 3. Information We Collect

We collect the following categories of information to deliver the App's features, provide support, manage accounts, and comply with legal obligations.

### A. Personal Data (identifiable information):

- Account and profile information: email address, display name, profile photo you provide.

- Contact information when you contact us (email contents).

- Financial information related to payments and purchases: purchase receipts, transaction identifiers processed through Apple In-App Purchases and RevenueCat (we do not collect raw card numbers; Apple handles payment card details).

- Identifiers: device identifiers provided by iOS (IDFV), Firebase identifiers associated with your account.

### B. Photos and Media Files:

- Photos, videos and other media files you upload to the App to create AI-generated images/videos (your uploaded content and the AI-generated results).

- Thumbnails and metadata associated with uploaded media (filename, upload timestamp).

- Photos you upload may contain human faces. We do not extract facial features, biometric data, or face geometry from these photos. See Section 4A for details on how photos containing faces are handled.

### C. Usage Data & Technical Data:

- Device information: device model, iOS version, unique device identifiers (IDFV), language and locale settings.

- Diagnostic and performance data: crash reports, logs, error traces (via Firebase Crashlytics).

- Network and connection data: IP address, approximate location inferred from IP for fraud prevention and localization.

- Analytics data: anonymized or pseudonymized usage metrics (features used, session duration, app flow) via Firebase Analytics.

### D. Sensitive Data:

We do not intentionally collect special categories of sensitive personal data (e.g., health, race, religion, political opinions). Do not upload sensitive personal data in photos or text you submit. If you submit sensitive data, you consent to its processing for the purposes described here.

## 4. How We Use Your Information

We use collected information for the following purposes:

- Provide and operate the App and its features (AI generation, previews, personal albums).

- Process account registration, authentication, and user support (Firebase Auth).

- Store and serve your uploaded media and generated content (Firebase Storage, Firestore).

- Process purchases, subscriptions, billing and refunds (Apple IAP, RevenueCat) and maintain financial records.

- Manage subscriptions and paywall experiments (Firebase Remote Config, RevenueCat) and support A/B testing of monetization.

- Improve and analyze the App's performance and usage (Firebase Analytics, Crashlytics).

- Detect, prevent and respond to fraud, abuse, security incidents, bugs and technical issues.

- Communicate with you about your account, purchases, policy updates, and promotional offers (if you opted in).

- Comply with legal obligations and respond to lawful requests by public authorities.

We do not sell personal information. Where local law defines "sale" differently, you may exercise opt-out rights as described below.

## 5. AI-Powered Features, Data Sharing, and Automated Processing

### 5.1 What Data Is Sent to Third-Party AI Services

When you use the App's photo or video generation features, the following data is transmitted to third-party AI services:

- Your uploaded photos (including photos that may contain faces of you and/or your partner)

- Generation parameters such as the selected template, prompt text you provide, aspect ratio, resolution, and duration settings

- A unique request identifier to match the generated output to your request

The following data is not sent to third-party AI services: your name, email address, device information, payment information, or any other personal account data.

### 5.2 Who Receives Your Data

Your photos and generation parameters are sent to:

- Wiro AI — our primary AI generation API provider. Wiro AI processes your photos to create AI-generated images and videos.

- Through Wiro AI, your data may be processed by underlying AI model providers, including:

- Google AI services (for image generation models)

- Midjourney (for image generation models)

### 5.3 How We Obtain Your Consent

The App obtains your explicit, informed consent before sending any photos to third-party AI services:

- During the onboarding process, a dedicated screen clearly explains what data will be sent, who it will be sent to, and for what purpose.

- You must actively check a consent checkbox and tap "Continue" to agree to this data sharing.

- If you do not provide consent, you will not be able to use the AI generation features, but you may still use other features of the App.

- You may review this information at any time via the App's Privacy Policy link in Settings.

### 5.4 Purpose and Use Limitations

- Uploaded media and metadata are transmitted to these services solely to create the requested AI-generated content.

- We will not use your uploaded photos or generated outputs to train third-party AI models unless we obtain explicit, informed opt-in consent from you. If you provide such consent, we will explain what data will be used and how.

- Third-party AI providers are contractually obligated to process your data solely for the purpose of generating the requested content and to provide the same or equal level of data protection as described in this Privacy Policy.

### 5.5 AI Output Disclaimers

- Outputs generated by AI may be imperfect, biased, or contain unintended content.

- You are responsible for reviewing outputs before sharing them publicly.

- We may retain generated outputs as described in the Data Retention section.

### 5.6 Opting Out

If you do not want your images to be processed by third-party AI providers, do not upload them or use the generation features. If you have questions about specific AI providers' handling of data, consult their privacy policies (links in Section 6).

## 5A. Face Data and Uploaded Photos

Couple Cut allows users to upload photos that may contain human faces for the purpose of AI-powered image and video generation. This section specifically addresses how we handle photos containing faces.

Collection: The App collects photos that users voluntarily upload to create AI-generated images and videos. These photos may contain faces. The App does not perform facial recognition, create face maps or facial geometry, extract biometric identifiers or face templates, or collect any facial feature data beyond the photograph itself. No face data is collected automatically; all photo uploads are initiated by the user.

Use: User-uploaded photos containing faces are used exclusively to generate AI-powered images and videos as requested by the user. We do not use face photos for identification, profiling, facial recognition, advertising, analytics, or any purpose other than fulfilling the user's content generation request.

Sharing and Disclosure: To generate AI content, user-uploaded photos (which may contain faces) are transmitted to our AI generation service providers:

- Wiro AI API — our primary AI generation provider

- Third-party AI models accessed through Wiro AI, which may include Google AI services and Midjourney

These providers process photos solely to produce the requested content and are contractually obligated to protect user data and provide the same or equal level of data protection. We do not share face photos with any other third parties, advertisers, data brokers, or for any purpose beyond content generation.

Storage: User-uploaded photos and AI-generated outputs are stored in Firebase Storage (Google Cloud infrastructure), which encrypts data at rest and in transit. On the user's device, photos are stored within the App's local storage. AI generation providers process photos transiently and do not retain them after generation is complete.

Retention: Uploaded photos containing faces are retained in cloud storage until the user deletes the content or their account. Upon account deletion, primary data (including uploaded photos) is deleted within 30 days, and backup copies are purged within 90 days. On the user's device, photos remain until the user removes them or uninstalls the App.

AI Training: We will not use your uploaded photos (including those containing faces) to train third-party AI models unless we obtain your explicit, informed, opt-in consent. See Section 15 for details on this preference.

User Control: You may delete any uploaded photo at any time from within the App. You may also request full deletion of all your uploaded media by deleting your account (see Section 9) or by contacting us at couple-cut@forvibe.app.

## 6. Third-Party Services and Data Sharing

We share data with service providers who perform services on our behalf. These third parties have access to personal data as needed to provide their services and are contractually obligated to protect it and to provide the same or equal level of protection as described in this Privacy Policy.

When you share content externally (e.g., share a generated image to social media), that destination's policies govern the shared copy. We are not responsible for how other platforms handle content you share.

## 7. Advertising and Tracking

Couple Cut does not display third-party advertising and does not integrate advertising SDKs (e.g., AdMob). We do not engage in targeted advertising or sell tracking data for advertising purposes.

## 8. In-App Purchases, Subscriptions & Billing

- Business model: Freemium with optional in-app purchases. We offer both subscription and one-time purchase options for credits or premium tiers.

- Subscriptions: Subscriptions auto-renew unless canceled. Auto-renewal billing is handled through the Apple App Store and managed via your Apple ID subscription settings. To cancel, go to your Apple ID subscriptions settings; cancellation will take effect at the end of the current billing period.

- RevenueCat is used to manage purchases and subscription status.

- Refunds: Our refund policy provides a 14-day refund window for purchases. Actual refund issuance is subject to Apple's refund process and applicable app-store rules; contact us and Apple Support to request a refund.

- We do not receive raw payment card data; Apple handles payment card processing.

## 9. Data Retention

We retain personal data only as long as necessary to provide the services, comply with legal obligations, resolve disputes, and enforce agreements.

Typical retention periods:

- Account and profile data: Retained while account is active. If you delete your account, we begin deletion and retain backups for up to 90 days to allow for recovery and legal compliance.

- Uploaded media and generated content (including photos containing faces): Retained until you delete the content or your account, except backups (up to 90 days) or as needed to comply with law.

- Transaction and billing records: Retained for up to 7 years for tax and regulatory compliance.

- Logs, analytics and diagnostic data: Retained in identifiable form for up to 24 months, then may be aggregated or deleted.

- Minimal anonymized or aggregated analytics data may be retained indefinitely for product improvement.

If you request deletion of your account and content, we will delete your primary data within a reasonable time period (typically 30 days), subject to verification and legal holds.

## 10. Security

We implement commercially reasonable technical, administrative and physical safeguards to protect personal data:

- Encrypted transmission (HTTPS/TLS) for data in transit.

- Data stored using secure cloud providers (Firebase) which encrypt data at rest.

- Access controls and authentication for internal systems; use of least-privilege access.

- Regular security testing, monitoring and use of third-party security services.

- Use of Firebase Security Rules and other platform security mechanisms.

No system is completely secure. We will notify affected users and authorities as required by law in the event of a data breach.

## 11. Children's Privacy (COPPA)

- The App is not intended for children under 13. We do not knowingly collect personal information from children under 13.

- If we learn that we have collected personal information from a child under 13 without verified parental consent, we will take steps to delete such information promptly.

- If you are a parent or guardian and believe your child under 13 has created an account, contact us at couple-cut@forvibe.app.

## 12. Your Rights (GDPR, CCPA and Similar Laws)

Where applicable, you have the following rights. To exercise any of these rights, contact us at couple-cut@forvibe.app. We may need to verify your identity before fulfilling requests.

- Right to Access: Request a copy of personal data we hold about you.

- Right to Rectification: Request correction of inaccurate or incomplete personal data.

- Right to Deletion (Right to be Forgotten): Request deletion of personal data (subject to exceptions such as legal retention requirements).

- Right to Restrict or Object to Processing: Request restrictions on certain processing activities or object to processing for direct marketing.

- Right to Data Portability: Request a copy of personal data in a portable and machine-readable format (where technically feasible).

- Right to Opt-Out of Sale: We do not sell personal data. If applicable in your jurisdiction and you believe otherwise, you may request an opt-out.

- Right to Withdraw Consent: Where processing is based on consent, you may withdraw consent at any time (withdrawal does not affect processing prior to withdrawal). This includes your consent to third-party AI processing of your photos — you may withdraw this consent at any time by discontinuing use of the generation features and deleting your uploaded content.

- Right to Lodge a Complaint: EU residents may lodge a complaint with a supervisory authority. California residents may contact the California Attorney General or file privacy requests per CCPA requirements.

We will respond to verifiable requests within applicable legal timeframes (typically within 30 days). We may extend by an additional 30 days when necessary and will notify you if we do so.

## 14. International Transfers

Your information may be processed and stored in countries outside your country of residence (for example, in servers used by Firebase, Vercel, RevenueCat and the AI providers). When we transfer personal data internationally, we rely on appropriate safeguards such as standard contractual clauses, transfers within the same corporate group, or processing by providers subject to adequate protections. Contact us if you need details about transfers and safeguards.

## 15. Choices and Opt-Outs

- Account settings: You can manage or delete your account and media from within the App.

- Communications: You can opt out of promotional emails by following the unsubscribe link in emails or contacting couple-cut@forvibe.app. Transactional emails (account and billing) are necessary and cannot be opted out.

- Analytics and diagnostics: We use analytics to improve the App. Where law requires, you may opt out of certain analytics tracking; follow in-app settings or contact us for assistance.

- AI data sharing consent: You may withdraw your consent to third-party AI processing at any time by not using the generation features. To delete previously uploaded photos, use the in-app deletion feature or contact us.

- AI training: We will not use your uploaded photos to train third-party AI models without your explicit opt-in consent. You can change this preference in app settings if/when offered.

## 16. Generated Content, Ownership and Sharing

- You retain ownership of the photos and media you upload and the outputs generated by the App, subject to any third-party rights in content you submit.

- By uploading media and using generation features, you grant Wolphy Apps and its service providers a limited, non-exclusive license to store, process, display, reproduce and transmit your uploads as necessary to provide the service (including use for backups, support and debugging).

- When you share generated content outside the App, that content may be governed by the receiving platform's terms and privacy policy.

## 17. Legal Disclaimers and Special Categories

- Accuracy and Use: AI-generated outputs are provided "as is." We disclaim liability for damages resulting from use of AI outputs. You are responsible for ensuring that you have rights to use any content you upload and that outputs do not infringe on the rights of others.

- This Policy may be updated from time to time. We will notify you of material changes through the App or by email. Your continued use of the App after changes constitutes acceptance of the updated Policy.

We may update this Privacy Policy from time to time. When we make changes, we will update the "Effective date" at the top of this page and notify you through the App or via email for material changes.
