# Terms of Use (Terms of Service)

Welcome to Couple Cut, an AI-powered photo and video generation application developed and operated by Wolphy Apps ("we", "us", "our"). Please read these Terms of Use ("Terms") carefully. They govern your access to and use of the Couple Cut mobile application for iOS (the "App") and any related services, features, content, and software (collectively, the "Service").
By downloading, installing, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

## 1. Acceptance and Changes
1.1 Acceptance. By using the Service you represent that you have read, understand, and agree to these Terms and our Privacy Policy. You affirm that you are of the minimum age required to use the Service (see Section 3).
1.2 Changes. We may modify these Terms at any time. We will post a revised version in the App and/or on our website and update the Effective Date. If the changes are material, we will attempt to notify you (e.g., in-app notice or email). Continued use of the Service after the Effective Date of an updated version constitutes acceptance of the revised Terms.

## 2. Who May Use the Service; Eligibility
2.1 Age and Capacity. The Service is not for children. You must be at least 18 years old or the age of majority in your jurisdiction, whichever is greater, to use the Service. By using the Service you represent and warrant that you meet the eligibility requirements and have capacity to form a binding contract.
2.2 Geographic Restrictions. The Service is offered globally but may not be available in all regions or countries. You are responsible for compliance with local laws when using the Service.

## 3. Account Registration and Security
3.1 Account. To use certain features of the Service you must register for an account and provide accurate, complete information. You are responsible for maintaining and promptly updating your account information.
3.2 Authentication. The App uses third-party authentication services (e.g., Firebase Authentication). By using such services you agree to their terms and the transfer and processing of your account data as described in our Privacy Policy.
3.3 Account Responsibility. You are responsible for all activity under your account. Keep your login credentials confidential. Notify us immediately of any unauthorized use or security breach by contacting couple-cut@forvibe.app.
3.4 Termination of Access. You may delete your account by following the in-App instructions or contacting support. We may suspend or terminate accounts for violation of these Terms or for security reasons; see Section 11.

## 4. User Content and Rights
4.1 User Content. The Service enables you to upload photos, videos, text, and other materials ("User Content") and to generate media using AI and third-party services (collectively, "Generated Content"). You retain ownership of the intellectual property rights in your User Content and Generated Content, subject to the licenses you grant below.
4.2 License to Us. By uploading or submitting User Content and by using the Service to create Generated Content you grant Wolphy Apps a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, use, reproduce, modify, create derivative works of, publicly display, publicly perform, and distribute your User Content and Generated Content solely for the purpose of providing, operating, improving, and promoting the Service (including analytics and aggregated or anonymized reporting). We may also use your content for customer support, troubleshooting, safety, and compliance.
4.3 License to Other Users. When you share content via public features of the App, you grant other users a license to view, share, and interact with that content as permitted by the App. Do not share content you do not want others to view.
4.4 User Representations and Consent. By uploading images of another person (including your partner), you represent and warrant that you have that person's consent to do so and that you have the legal right to submit the content. You are solely responsible for obtaining any necessary permissions and releases.

## 5. Acceptable Use and Prohibited Conduct
5.1 Acceptable Use. Use the Service lawfully, responsibly, and ethically. You may only use the Service for its intended purpose: creating, storing, and sharing couple-oriented photos and videos and related activities.
5.2 Prohibited Conduct. You must not, and must not assist or permit others to:
- Violate any applicable law or regulation.
- Upload, share, or generate content that is unlawful, defamatory, obscene, pornographic involving minors, promotes violence, harassment, hate speech, terrorism, or illegal activities.
- Upload or use content that infringes others' intellectual property rights, privacy rights, or publicity rights.
- Upload images of people without their consent.
- Attempt to access, probe, scan, or test the vulnerability of any system or network or breach any security or authentication measures.
- Use the Service to send spam, unsolicited messages, or bulk communications.
- Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the App, except to the extent permitted by law.
- Interfere with the operation of the Service or any user's enjoyment of the Service (including using bots, scripts, or other automated means).
- Attempt to bypass, defeat, or manipulate any paywall, usage limits, or security features.
- Use the Service to create deepfakes or other misleading or impersonating media intended to deceive, defraud, or harm others.
5.3 Enforcement. We may investigate and take any action we deem appropriate (including removing content, suspending or terminating accounts, and reporting to authorities) if you violate these Terms or pose a risk to our users, the public, or the Service.

## 6. AI-Generated Content, Data Sharing, and Disclosures
6.1 Nature of AI Outputs. The Service uses AI and third-party generation services to produce Generated Content. AI outputs may be imperfect, biased, inaccurate, or inappropriate. We do not guarantee that Generated Content will be free of errors, offensive material, or infringing content.
6.2 Third-Party AI Processing and Data Sharing. To generate AI-powered photos and videos, the App sends your uploaded photos and generation parameters to third-party AI services. Specifically:
- What is sent: Your uploaded photos (which may contain faces), selected template, prompt text, and generation settings (aspect ratio, resolution, duration).
- Who receives it: Your data is sent to Wiro AI (our primary AI generation provider), which may route processing through third-party AI models including Google AI services and Midjourney.
- Purpose: Your data is processed solely to generate the AI-powered images and videos you request.
- Consent: The App obtains your explicit consent before any photos are sent to third-party AI services. During the onboarding process, you are presented with a clear explanation of this data sharing and must actively agree before using generation features.
- Opt-out: If you do not consent to this processing, you may choose not to use the AI generation features.

6.3 No Reliance. You should not rely on Generated Content for any purpose that requires accuracy (e.g., legal, medical, financial, safety-critical). You are solely responsible for reviewing and verifying content before sharing, publishing, or acting on it.
6.4 User Responsibility. You are responsible for how you use Generated Content and for ensuring that such use complies with these Terms and all applicable laws and third-party rights.
6.5 Right to Remove or Modify. We may filter, refuse to generate, alter, or remove Generated Content that we reasonably determine violates these Terms or third-party policies.
6.6 Attribution and Disclosure. You agree to comply with any applicable laws or platform rules regarding disclosure when sharing or publishing AI-generated media (for example, indicating that media was AI-generated) where required.

## 7. Intellectual Property
7.1 Our IP. The Service, including all software, source code, designs, text, graphics, user interface elements, logos, trade names, trademarks, and other content provided by us, are the exclusive property of Wolphy Apps or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, modify, create derivative works of, or publicly display our proprietary content except as expressly permitted.
7.2 Feedback. If you provide feedback, suggestions, or ideas about the Service, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use such feedback for any purpose.

## 8. Credits, Purchases, Subscriptions, and Billing
8.1 Credits Economy. The App operates on a credit-based economy. Credits may be earned through daily rewards and referrals, or purchased via in-App purchases. Credits are non-transferable, non-refundable (except as stated in our Refund Policy), and may expire or be changed in number, cost, or functionality at our discretion. We are not responsible for lost or expired credits.
8.2 In-App Purchases and Subscriptions. The Service offers purchases, including:
- One-time purchases (e.g., credit packs).
- Subscriptions (recurring payments) to unlock premium features or content ("Subscription(s)").
All purchases are processed through Apple's In-App Purchase system and/or third-party payment platforms we use (e.g., RevenueCat). By subscribing you authorize recurring charges to your Apple ID or payment method and agree to the terms of the relevant payment processor and App Store.
8.3 Auto-Renewal and Cancellation. Subscriptions automatically renew at the end of each billing period unless canceled prior to renewal. To cancel, follow your App Store subscription management options or any in-App cancellation flows we provide. We are not responsible for billing disputes handled by the App Store; cancellations must be effected according to the App Store rules for iOS purchases.
8.4 Pricing and Taxes. Prices and fees are displayed in the App. You are responsible for all applicable taxes. We may change prices at any time; changes will not affect already paid periods except as required by law.
8.5 Refund Policy.
- Developer Refund Policy: We offer refunds for eligible purchases within 14 days of purchase subject to our review and applicable laws. Refund requests for App Store purchases are generally handled by Apple; you may request a refund through Apple's mechanisms. If you contact us at couple-cut@forvibe.app, we will assist where possible and in accordance with App Store policies and applicable law.
- Credits and consumables are generally non-refundable even if the related purchase is refunded by a platform.
8.6 Chargebacks and Fraud. You must not initiate a chargeback or dispute to avoid the obligations in these Terms. We may pursue collection of amounts owed and take action against fraudulent or abusive purchases.

## 9. Third-Party Services and Integrations
9.1 Third-Party Services. The Service integrates with third-party services and libraries, including Firebase (Firestore, Auth, Storage, Remote Config), Wiro AI, Google AI services, Midjourney, RevenueCat, Apple IAP, and analytics/crash reporting tools (e.g., firebase_core, crashlytics). Use of those services is subject to their respective terms and policies. By using the Service you consent to the transfer, storage, and processing of your information by these third parties and across jurisdictions.
9.2 Apple App Store. The App is available on Apple's App Store. You acknowledge that Apple is not a party to these Terms and that Apple has no responsibility or liability for the Service, its content, or any claims arising from its use. Apple's App Store terms also apply to your use of the App.

## 10. Privacy
Your privacy is important to us. Our Privacy Policy describes how we collect, use, share, and protect your personal information, including detailed information about how your photos are shared with third-party AI services. ## 11. Termination
11.1 By You. You may stop using the Service at any time and delete your account through the in-App settings or by contacting us at couple-cut@forvibe.app.
11.2 By Us. We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if we reasonably believe you have violated these Terms.
11.3 Effect of Termination. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, and dispute resolution) will survive.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. AI-GENERATED OUTPUTS ARE PROVIDED WITHOUT ANY GUARANTEE OF QUALITY, ACCURACY, OR APPROPRIATENESS.

## 13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WOLPHY APPS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Wolphy Apps and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) your User Content or Generated Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

## 15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of Turkey, without regard to conflict of law principles. Any disputes arising under these Terms will be resolved through binding arbitration or in the courts of Istanbul, Turkey, unless otherwise required by applicable consumer protection laws in your jurisdiction.

16.1 Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Wolphy Apps regarding the Service.
16.2 Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.
16.3 Waiver. Our failure to enforce any provision of these Terms will not constitute a waiver of that provision.
16.4 Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
